Group launches Federal Court Adani challenge

EDO NSW is acting for Mackay Conservation Group, in judicial review proceedings to challenge the Commonwealth Environmental Approval of the Adani Carmichael coal mine in the Galilee basin.

The Federal Court of Australia will hear that in assessing the project under the Environment Protection and Biodiversity Conservation Act 1999 (Cth), the Minister failed to take into account a mandatory consideration, namely the impacts of greenhouse gas emissions produced by burning coal from the mine.

In particular, the impacts of burning coal on the world heritage values, natural heritage values and the environment of the Great Barrier Reef should have been considered. The Mackay Conservation Group will argue that as a result of these omissions, the approval for the Carmichael mine is invalid.

The first directions hearing for the matter is schedule for 2 February 2015.
